Some contracts may specify what to pay in the event of a breach. This is often referred to as lump sum damages. Written contracts may consist of a standard agreement or a letter confirming the agreement. (2) The contracting entity shall include clauses relating to matters which are not covered by the basic agreement but which apply to the contract to be negotiated in the same way as if there were no basic agreement. 1. Basic agreements shall contain (i) the clauses necessary for the negotiation of contracts by law, the implementing Regulation and this Regulation, and (ii) shall include in each contract, where appropriate, other clauses prescribed in this Regulation or in the rules on the acquisition of agencies to which the parties agree. . . .
